Luis Farlow: Some policies have a restriction on the amount of money per day, and a total amount that they will pay for the total car rental period ( say 20 a day, 600 max, for example) If the adjuster knew that the the shop was going to need the 23 days to repair the vehicle, and ok'd the repairs, it seems that there shouldn't be a problem, but you want to check and see if there is a cap on the amount they pay for the total period. Allstate is a large insurance company, and they have been around for many years. They will want to keep their insured's satisfied. On the whole, it really shouldn't have taken the shop that long to fix the car, unless there were extenuating circumstances in fixing it. Still- the adjuster was aware of the time problem, and ok'd the repair. They should have spoken to you on the limitations of your policy if there were any. As far as the week or so before it got into the shop, an auto policy usually states that the rental expense is for wh! ile the vehicle is in the shop, you may have no recourse there. Have you spoken to your Allstate agent? Have they gone to bat for you with the claims department? Your agent can go over your policy with you, and if there is a discrepancy with how the claim is going, they should be there for you. That's how we do it at State Farm. Byron Fortmann: They only owe for the time the car was actually under repairs, and they only owe for the time the car was NOT safely driveable. If the shop caused delays, the shop owes for those days of rental, not Allstate. If the labor hours do not support 23 days of rental they will not pay it. What can you do....have the shop pay it because that's who owes you those days.
Dawn Saha: Nothing. The at fault parties insurance is only responsible for REASONABLE rental expens! es- your shop took its time... so they dont have to pay for th! e extra days that werent needed. Maybe you should talk to your slow shop about covering it..Also,they arent responsible for rental while they are investigating the claim or before your vehicle is in the shop if its drivable.. you should have gotten it in the shop sooner or gone through your own insurance if you were afraid of driving it....Show more

Ulysses Failey: Read the policy Allstate issued. If they said they'd pay, they owe you money. Case closed. Unless there's a compelling reason or extenuating circumstance which affects the terms of the policy, they must honor its provisions.
